mon-recommandé-électronique.fr is a solution deployed by Tessi Documents Services that enables you to send 100% electronic tracked & registered mail. Our service can be used by estate agents, condominium managers, insurance professionals, etc.
If you are a private individual and you have received an email notification of an electronic registered letter, this means that the sender has obtained your prior consent to send you an electronic registered letter (ERL). To find out the identity of the sender, you must first acknowledge receipt of your ERL, as you would for registered post. If you do not accept your ERL within 15 days of your email notification, your mail will be rendered inaccessible and the sender will receive proof of no delivery.
Electronic mailings are governed by the eIDAS Regulation at the European Union level, and by the French Post and Electronic Communications Code.
eIDAS Regulation No. 910/2014 of 23 July 2014 is a European Union regulation that came into force on 1 July 2016, establishing a common basis for secure electronic exchanges between citizens, businesses and administrations in EU member states. Articles 43 and 44 are devoted to electronic registered mail.
The details of the eIDAS regulation are set out in French law in Articles R53 and L.100 of the French Post and Electronic Communications Code and its implementing decree 2018-347. Since 1 January 2019, when Decree 2018-347 came into force, only electronic registered letters routed by a qualified trust service provider may be used when the legal context requires a registered letter to be sent. Electronic registered letters are the only equivalent to paper registered letters. Tessi Documents Services is an ANSSI-qualified service provider for the delivery of electronic registered letters.
eIDAS Regulation No. 910/2014 of 23 July 2014 is a European Union regulation that came into force on 1 July 2016, establishing a common basis for secure electronic exchanges between citizens, businesses and administrations in EU member states. Articles 43 and 44 are devoted to electronic registered mail. It provides a legal framework for trusted services, such as electronic registered mail, by defining security and interoperability requirements. It also introduces a mechanism for the mutual recognition of Member States' electronic identification systems.
An electronic registered letter sent by Tessi Documents services, a service provider qualified by ANSSI, is an electronic registered letter with acknowledgement of receipt that meets the requirements of Article 44 of the eIDAS Regulation and those of Article L100 of the French Post and Electronic Communications Code.
A qualified electronic registered letter (ERL) is the strict equivalent of registered paper letter with acknowledgement of receipt sent by post, as long as it is sent by a qualified trusted service provider, such as Tessi Documents Services.
A qualified ERL must meet the conditions set out in Article 44 of the eIDAS Regulation in order to benefit from a presumption of reliability, and in particular:
  • Verification of the sender's identity with a high degree of confidence
  • Verification of the identity of the recipient with a substantial degree of confidence
  • Guaranteed integrity of the registered letter
  • Proof of filing and delivery of its contents; time-stamping of every stage in the lifecycle of each ERL

A tracked email with acknowledgement of receipt, which complies with article 43.1 of the European eIDAS regulation, can be used as evidence in court because it was sent by Tessi Documents Services, which can prove the reliability of its process. On the other hand, a CSE-AR is not the legal equivalent of registered paper letter because it does not require the recipient's consent, and the recipient does not have to verify his or her identity in order to acknowledge receipt of the electronic mail.
You will be able to access the contents of the electronic registered letter and find out who sent it. The sender will then receive proof of receipt.
The legal effects of an electronic registered letter are the same as for a paper registered letter (Art. 1366 of the French Civil Code). By sending an electronic registered letter to a recipient, the sender benefits from proof of the content sent.
If you reject your ERL, its contents will no longer be accessible to you. It will not be possible to change your choice to "accept" or "disregard" your ERL. The sender will then receive a proof of refusal.
If you disregard your ERL (i.e. if you take no action to accept or refuse it), its content will no longer be accessible to you after the legal deadline of 15 days following its notification. The sender will then receive proof of non-delivery.
The legal effects of electronic registered mail are the same as for paper registered mail (Art. 1366 of the French Civil Code). Refusing or disregarding an electronic registered letter (ERL) may be held against the recipient by a judge in the event of a dispute. Moreover, refusing an ERL does not mean that the sender must ultimately notify the addressee by paper registered letter: the recipient has already contractually agreed to be notified electronically.
In order to refuse a registered email, you will need to identify yourself to our services using one of the identification methods available. Once your identity has been verified, you will be able to refuse the email.
Please note that once a registered letter has been refused, it is no longer possible to accept it or access its contents. If you reject your ERL, its contents will no longer be accessible to you.
If you no longer wish to use the www.mon-recommande-electronique.fr,simply refuse the service's General Terms and Conditions of Use (T&C). To do this, go to your personal space, under the heading " My account ", then " Reading and Reviewing the Terms and Conditions ". Click on the " Terms and Conditions" button and then on "Refuse". Please note: you will no longer have access to your personal area at www.mon-recommande-electronique.fr ! So be sure to download and save any electronic items you receive on another medium beforehand. Any electronic transmission that remains pending (status notified) in your personal space at the time of rejection of the T&C will nevertheless remain binding on you in the same way as any other transmission that has not been opened
In order to guarantee equivalence with the paper registered letter with acknowledgement of receipt, your identity must be verified by Tessi Documents Services with a "substantial" level of confidence, before your electronic registered letter is delivered. This substantial level can only be achieved by a physical face-to-face process or one recognised as equivalent to face-to-face by a state body. A certificate for which your identity has been verified face-to-face, a means of identification delivered face-to-face, a substantial digital identity recognised by the state or a PVID-certified remote identity verification process not only guarantee this level of trust but also ensure that you remain on a 100% paperless process when using the Service.
